Under the law (which is enforced by the TCPA), you need to prove that the people you are sending texts to have agreed to receive them.
- Be upfront with your customers and potential customers; advise them of exactly what types of messages they will be receiving, and how often they will be receiving them.
- Consent can be obtained in several ways, like during the checkout process on your website, on a signup or inquiry form, or even in-person in store or at a live event.
- You MUST keep a record of who, when, and how a customer agreed to receive your text messages.
Clear and Concise Messages
- SMS messages are typically 160 characters or less and require brevity and clarity due to the limited screen space on a cellphone, and readers short attention span.
- Have a single, clear call to action (CTA) in each message to help direct the recipients next step without causing any confusion.
- Proofread before sending. The smallest typo or grammatical error can detract from the professionalism of your message and confuse the reader.
Make it Easy to Opt-Out
- Every SMS message should include simple instructions on how the recipient can stop receiving messages.
- This is usually done by including a short line at the end of the text message such as “Reply STOP to unsubscribe.”
